This activity presents how other influences such as federal laws, modern health care delivery systems, and availability of resources affect compliance with EMTALA. An update of actual claims of EMTALA violations, showing what factors caused the patient claim to win and the hospital to lose is included.

• Describe the full range of penalties that may be assessed due to EMTALA violations.
• Describe three ways nurses can reduce the risk of harm from EMTALA violations.
